Who Can Sell an Inherited House in Florida?

It depends on how the house was titled and whether probate is needed:

  • Joint owners, life estate, or lady bird deed, or a trust. The house may pass without probate. The surviving owner, remainderman, or trustee can sell.

  • Formal administration. The court appoints a personal representative (PR) under Chapter 733, F.S.. Real property sales are governed by §733.613. If the will gives the PR a power of sale, the PR can usually sell without a court order. If there’s no will, or the will doesn’t grant that power, the PR can still sell, but title doesn’t pass until the court authorizes or confirms the sale. (The general PR powers in §733.612 specifically exclude real property.)

  • Summary administration. Under Chapter 735, F.S., this is a shorter process. Under §735.201, it’s available when the non-exempt estate is $150,000 or less, or when the person died more than 2 years ago. (The limit was $75,000 before a 2026 amendment, ch. 2026-57.)

  • Homestead property. Florida homestead has special protections and limits on who inherits it (Fla. Const. Art. X, §4). Title companies often require a court order determining homestead before a sale.

In Jacksonville, probate cases are filed with the Duval County Clerk in the Fourth Judicial Circuit.

Common Problems We Can Help With

  • Heirs who live out of state

  • A house full of belongings

  • Deferred repairs, an old roof, or water damage

  • Back property taxes or a mortgage still owed

  • Several heirs who want to cash out

How It Works

  1. Tell us about the property and the estate’s status. Is probate opened? Is there a PR or trustee?

  2. Walkthrough. It can be done in person or by video for out-of-state heirs.

  3. Written cash offer. We’ll say whether it’s a direct purchase or an investor introduction.

  4. Close with a Florida title company. The title company confirms who has authority to sign and pays off any liens. We can also close after court approval if it’s needed.

FAQ

Can I sell before probate is finished? Often you can sign a contract once a PR is appointed. Closing may need letters of administration, plus a court order if the will doesn’t grant a power of sale. Your probate attorney will confirm.

Do all heirs have to agree? It depends on title and the PR’s authority. Disagreements should go to your attorney.

Do I have to clean out the house? No. Take what you want and leave the rest.

Who pays the closing costs? We’ll spell that out in the written offer.
